| Abstract | In Harrison, the claimant argued that he was not liable for any sum standing to his debit under the agreement because of MBNA's non-compliance with the Consumer Credit Act 1974 including, inter alia, a failure to send the claimant a copy of the 'terms and conditions'. This case is important because, other than the decision being based on non-compliance with various statutory provisions, the manner in which the creditors sought payment also formed the basis of the decision. |
