AbstractProposes a threshold formula for indexing the discount rate in personal injury claims, namely the net rate of return. Examines: (1) the discount rate itself, commenting on the significance of the House of Lords decision in Wells v Wells; (2) the gross redemption yields on Index-Linked Government Stock (ILGS), looking at Appendix B of the Ogden Tables; and (3) a proposed formula-based approach for the setting of the discount rate, which resets the rate when the historical three-year moving-average ILGS yields show a persistent and significant shift.
