Abstract | This paper examines the leasehold land system as a government means of allocating private property rights by contract. It argues that essentially this land system differs little from the freehold land system in terms of governance. Unlike freehold, leasehold tenure is held for a specified period of years. Otherwise, like freehold, it confers full private property rights of use, income and transfer. Examples from Hong Kong show that the leasehold system as a form of'planning by contract' is not inferior to zoning legislation either in terms of detail or control of development. |
