Abstract | Using the Hong Kong experience as a point of departure, in particular the 2013 40-day dock workers’ strike against the Hong Kong International Terminals Ltd (HIT) companies, this paper will examine the social consequences of outsourcing and other employer strategies to avoid labour law obligations. Surprisingly, some of these strategies have their basis in statute law, and have been, albeit reluctantly, endorsed by the courts. This paper will address the question: in a labour law system in which the principle of freedom of contract has priority of place, to what degree should employer avoidance strategies be regulated or even curtailed? |
