Abstract | This paper explores the tension between regulation of fishing on the high seas and investment protection under international investment law. Commentators often think of the UN Convention on the Law of the Sea when they talk about the ability of states to regulate the high seas. They neglect to recall the 1958 Geneva Convention on Fishing and Conservation of the Living Resources of the High Seas, which provides truly exceptional powers to member states at regulating fishing on the high seas, including the ability to commence arbitration under this treaty. This paper analyzes arbitration under this treaty and posits that it provides a significant way for states to protect fishing on the high seas unlike other treaties in this realm. |
