Abstract

The COVID-19 pandemic has caused unprecedented loss of lives and livelihoods. The insurance industry has shared in this loss. This chapter examines the role of business interruption insurance (BII) in ameliorating-or failing to ameliorate-the financial consequences of the pandemic. In doing so, it explores the nature of BII policies and reviews some of the litigation, including FCA v Arch, arising from COVID-19-related claims by BII policyholders. It considers the development of pandemic risk insurance and the possibility of the same being available before the next-inevitable-pandemic.
