| Abstract | The vigorous development of our country's mortgage system and the decline of the dian system reflect the imbalanced development in the protection of public and private property. Improving the dian system will be beneficial for implementing the constitutional protection of private property and further developing the socialist market economy. Proceeding from the systems of housing mortgage and dian, this article explores the protection of private property in our country and its significance for the development of the contemporary market economy, in the hope of providing a useful reference for the innovation of China's civil law system. 我国抵押制度的蓬勃发展和典权制度的式微体现了公共财产和私有财产保护发展的不均衡。完善典权制度将有利于落实宪法私有财产的保护，进一步发展社会主义市场经济。文章从房屋的抵押、典权制度出发，对我国私有财产的保护以及其对当今市场经济发展的意义进行探讨，以期对我国民法制度的创新提供有益借鉴。 |
