Abstract

For decades now, the study and teaching of jurisprudence has been dominated by the question of how law relates to morality. But why should this be the key question? How did this relation attain such centrality, and what does it sideline – intentionally or otherwise – in terms of intellectual enquiry and practical engagement? This paper addresses a core tenet of contemporary jurisprudence, and considers whether its prominence has unduly restricted the vision of the subject.
