AbstractA more liberal notion of prejudice than that so far adopted by the Hong Kong courts should be accepted. Prejudice short of actual impairment of the right to defend oneself should suffice for the purpose of a finding of a violation of the right to speedy trial. A conceptual distinction should be drawn between a violation of the right to speedy trail and the granting of stay, which is a discretionary remedy.
