AbstractThis paper provides a historical review of the institution of oath, arguing that the oath of allegiance has always been political in nature and is inimical to free speech, and that the court has failed to properly appreciated the nature of oath in balancing the importance of the right to elected office and the consequences of failure to take an oath in the recent oath cases.
